If you own a patent and don’t defend it when it could be compromised, the patent can become null and void in the future. You must defend a patent for it to have worth, hence what is happening now.
Ultimately the patent system will likely have to change and their are arguments both sides on this one. Protecting physical patents makes sense, but in some cases patent litigation has occurred on the basis of ideas which I believe may be curtailed soon.
